1.1 These Terms & Conditions ("Terms") govern your access to and use of the website clepto.co.uk (the "Platform," "Site," or "Marketplace"), operated by Clepto ("Clepto," "we," "us," or "our").
1.2 Clepto provides an online marketplace that allows registered users ("Sellers") to list clothing and related items for sale, and allows other registered users ("Buyers") to browse, purchase, or make offers on those items. Collectively, Buyers and Sellers are referred to as "Users" or "you."
1.3 By creating an account, browsing, listing an item, or completing a purchase on the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, you must not use the Platform.
1.4 We may amend these Terms from time to time. We will notify Users of material changes by posting an updated version on this page with a revised "Last updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
2.1 Clepto is a marketplace, not a retailer, auctioneer, or agent of any Buyer or Seller. We provide the technology and platform that allow Users to connect, list items, communicate, and complete transactions with one another. We are not involved in and do not participate in any contract of sale that forms between a Buyer and a Seller.
2.2 Any contract for the sale of goods formed as a result of a listing on the Platform is made directly and exclusively between the Buyer and the Seller. Clepto is not a party to that contract, does not take title to any goods listed, and has no obligation to fulfil any transaction.
2.3 We do not manufacture, inspect, warehouse, authenticate, package, or ship any items listed on the Platform (unless we expressly state otherwise for a specific feature). Descriptions, photographs, sizing, condition, and pricing of items are provided solely by the Seller, and Sellers are solely responsible for the accuracy of their listings.
3.1 To the fullest extent permitted by law, Clepto accepts no responsibility and no liability whatsoever for:
3.2 Payments are processed by third-party payment providers (which may include services such as PayPal, Stripe, or similar checkout providers) and are not held, controlled, or guaranteed by Clepto. Once a payment is initiated, it is governed by the terms of that third-party payment provider, and any dispute regarding a transfer of funds must be raised with that provider or directly between the Buyer and Seller. Clepto does not act as an escrow service and does not guarantee any refund.
3.3 Users transact with one another at their own risk. We strongly encourage all Users to communicate through the Platform, review Seller ratings and feedback where available, and exercise the same caution they would when dealing with any private individual online.
3.4 Nothing in this Section 3 excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation by us, or for any other liability that cannot lawfully be excluded or limited under English law, including your statutory rights under the Consumer Rights Act 2015 where applicable (see Section 9).

4.3 Consumer sales vs. private sales. Where a Seller is acting as a business (i.e., selling clothing on a commercial basis, such as a reseller or trader) and a Buyer is a consumer, the Seller — not Clepto — bears the statutory obligations of a trader under UK consumer law, including rights to returns, refunds for faulty goods, and cancellation rights for distance selling. Where a sale is between two private individuals, standard consumer protection legislation such as the right to cancel within 14 days does not automatically apply, and the transaction is instead governed by general contract law and, where relevant, the Sale of Goods Act 1979.
5.1 You must not use the Platform to list, sell, or attempt to sell: counterfeit or replica goods; stolen items; items that infringe third-party trademarks or copyright; hazardous items; or any item prohibited by UK law.
5.2 You must not use the Platform to harass other Users, post false or misleading listings, manipulate reviews or feedback, or attempt to complete transactions off-platform specifically to circumvent buyer/seller protections, fees, or these Terms.
5.3 We reserve the right, but are not obliged, to remove any listing, suspend any account, or restrict access to the Platform at our sole discretion where we reasonably believe a User has breached these Terms or applicable law.
6.1 Where Clepto charges a listing fee, transaction fee, or commission on completed sales, the applicable fees will be clearly displayed to Sellers before a listing is published or a sale confirmed.
6.2 Fees are non-refundable except where required by law or expressly stated otherwise.
7.1 The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any listing, User, or item is accurate, genuine, or of satisfactory quality.
7.2 To the fullest extent permitted by law, Clepto excludes all warranties, conditions, and representations, whether express or implied, regarding the Platform, the listings on it, or the outcome of any transaction.
7.3 Subject to Section 3.4, Clepto's total aggregate liability to any User arising out of or in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid by that User to Clepto in the twelve (12) months preceding the claim, or £100, whichever is greater.
7.4 We shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, or loss of goodwill, arising from your use of the Platform.
8.1 Analytics. We use Google Analytics and Firebase (both provided by Google) to collect information about how visitors use the Platform, including pages viewed, session duration, device and browser type, approximate location, and general usage patterns. This data helps us understand traffic trends, improve site performance, and diagnose technical issues. Data collected through these tools is processed in accordance with Google's own privacy and data practices, in addition to our Privacy Policy.
8.2 Advertising. We display advertisements provided by third-party advertising networks, including Google AdSense and other third-party ad partners. These networks may use cookies, device identifiers, or similar tracking technologies to serve advertisements based on your visits to this and other websites, and to measure the effectiveness of those advertisements. We do not control the content of third-party advertisements and accept no responsibility for the accuracy, legality, or suitability of any product or service advertised on the Platform through these networks.
8.3 Cookie consent. Where required under the UK GDPR and the Privacy and Electronic Communications Regulations (PECR), we will request your consent before setting non-essential cookies, including those used for analytics and advertising personalisation. You can manage or withdraw your cookie preferences at any time via the cookie settings tool on the Platform or through your browser settings.
8.4 Opting out. You may opt out of personalised advertising served by Google by visiting Google's Ads Settings, and you may install the Google Analytics Opt-out Browser Add-on to prevent your data from being used by Google Analytics.
8.5 Further detail on what data is collected, why, and how long it is retained is set out in our separate Privacy Policy, which forms part of these Terms by reference.
9.1 Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Protection from Unfair Trading Regulations 2008, or any other applicable UK consumer protection legislation, to the extent those rights apply to your specific transaction (for example, where you buy from a Seller acting in the course of a business).
9.2 Where a Seller is a private individual selling in a personal, non-business capacity, certain statutory consumer rights (such as the automatic right to cancel a distance sale within 14 days) do not apply in the same way, and Buyers should be aware that such purchases are closer to a private sale between individuals.
10.1 We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or put other Users or the Platform at risk.
10.2 You may close your account at any time by contacting us, subject to the completion of any outstanding transactions.
11.1 These Terms are governed by the laws of England and Wales.
11.2 Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that consumers resident elsewhere in the UK may also be entitled to bring proceedings in their local courts under mandatory consumer protection law.
